TLDR
- reTrek is offered with a free tier (one route + one quest) and a PRO subscription (full content). Subscriptions are billed by Apple and auto-renew until you cancel.
- You can cancel anytime through your Apple ID subscription settings, the App Store, or from inside reTrek.
- You must be at least 16, or have parental consent.
- Don’t reverse-engineer the App, don’t fake your fitness data, and don’t use reTrek’s content to train AI models. Full list of prohibitions in Section 6.
- We’re a small indie studio in Norway. Norwegian law governs these Terms.
This summary is plain-language and not legally binding; the sections below are the full Terms of Service.
1. Agreement to Terms
By downloading, accessing, or using the reTrek mobile application (“App,” “Service”), provided by Do Not Panic AS (“Company,” “we,” “us,” “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
2. Changes to Terms
We may modify these Terms at any time. Material changes will be reflected by updating the “Last updated” date and, where appropriate, by an in-app notice. Continued use after changes constitutes acceptance.
3. Service Description
reTrek is an iOS application that turns your daily walking into virtual adventures along famous routes and story-driven quests. The Service uses step and distance data from Apple Health to track your progress along selected virtual routes; some content unlocks at milestones along the route. Availability of the Service is subject to the Apple App Store regions in which it is published.
4. Account Registration & Age Restriction
- You must register to use the Service via Magic Link, Google Sign-In, or Sign in with Apple.
- We collect your email and, where the sign-in provider supplies it, your name and profile photo. With Sign in with Apple, you may choose to share a private relay email instead of your real address.
- You must be at least 16 years old; users under 16 may only register with parental consent.
5. Subscriptions, Payments & Refunds
- The Service is offered as a subscription with a free tier (one route and one quest) and a PRO tier (full access to all routes and quests, including future releases).
- All purchases are processed through the Apple App Store. Subscriptions are billed by Apple to your Apple ID payment method. Pricing in your local currency is shown in the App Store before purchase.
- Auto-renewal. Subscriptions are billed and auto-renewed by Apple per the Apple Media Services Terms and Conditions in effect at the time.
- Cancellation. You can cancel anytime through your Apple ID subscription settings on your device, through the App Store, or from inside reTrek. You retain PRO access until the end of the current billing period.
- Refunds. Refunds, when applicable, are handled by Apple per Apple’s then-current refund policy. We do not directly process refunds for App Store purchases.
- Account deletion. Deleting your reTrek account does not automatically end your subscription; cancel separately through Apple to stop future billing.
6. User Conduct & Prohibited Uses
6.1 Prohibited Conduct
You agree not to engage in any of the following, including without limitation:
- Violate any applicable law, regulation, or third-party right (including privacy, publicity, or intellectual property).
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying algorithms of the Service or any API.
- Perform any unauthorized API calls, scraping, data-mining, or “bot” activity.
- Submit fabricated step or distance data, or use third-party tools to inflate fitness data sent to the Service.
- Interfere with or disrupt the integrity or performance of the Service, including denial-of-service attacks or overloading our systems.
- Transmit any viruses, worms, malware, or other harmful code.
- Use the Service to send unsolicited communications, spam, or phishing.
- Harass, threaten, or defame others through any content you submit (such as reviews or feedback).
- Use the Service, or any content from it (including but not limited to route descriptions, milestone media, quest content, or other reTrek-owned material), to train, develop, or evaluate AI or machine-learning models.
- Take any other action that violates the spirit of these Terms or harms the Service, its users, or third parties.
6.2 Enforcement & Termination
We reserve the right, at our sole discretion, to investigate and immediately terminate or suspend your access if you violate these prohibitions or breach any provision of these Terms. We may report any activity we suspect is unlawful to law enforcement authorities.
6.3 Indemnification
You agree to indemnify and hold Do Not Panic AS, and its affiliates, officers, directors, and employees, harmless from any claim, demand, loss, or damages (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or your misuse of the Service.
7. Intellectual Property
- All content within the Service, including routes, quests, milestone media (text, images, video), illustrations, branding, and software, is owned by Do Not Panic AS or its licensors and is protected by intellectual property laws.
- Subject to these Terms, we grant you a limited, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices you own or control.
- Any reviews, feedback, or other content you submit through the Service may be used by us to operate, improve, and promote the Service. You retain ownership of your submissions; you grant us a worldwide, royalty-free license to use them for those purposes.
8. Security Measures
We implement reasonable technical and organizational measures, including:
- HTTPS/TLS for all traffic.
- Encryption at rest for stored data.
- Regular backups.
- Automated vulnerability scanning.
- Role-based access control and secure secrets management.
9. Third-Party Services & Data Transfers
We engage third-party service providers for key functions, including:
- Subscription management (via the Apple App Store and our subscription processor).
- Authentication.
- Email delivery.
- Error monitoring.
- Infrastructure hosting and content delivery.
- Health and fitness data (via Apple Health).
We host data in the European Economic Area where possible. For any transfers outside the EEA, we and our subprocessors rely on EU Standard Contractual Clauses or other adequate safeguards. A complete register of our subprocessors is available on request at help@retrek.me.
10. Termination
We may suspend or terminate your access for any violation of these Terms, without notice. You may delete your account at any time through your account settings. Deletion requests log you out immediately. Your data is permanently erased within 30 days. While the deletion is being processed, re-registration with the same email is blocked; once the erasure completes, no record of the original account is retained, including any registration block.
11. Warranty Disclaimer & Limitation of Liability
11.1 Disclaimer of Warranties
The Service is provided “AS IS,” “WITH ALL FAULTS,” and “AS AVAILABLE,” without warranty of any kind. To the fullest extent permitted by law, Do Not Panic AS disclaims all warranties, whether express, implied, statutory, or otherwise, including without limitation any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee that:
- The Service will meet your requirements or operate without interruption, delay, or security vulnerabilities.
- Step or distance data interpreted by the Service will be free of measurement error.
- Any defects will be corrected.
11.2 No Medical or Fitness Advice
reTrek is not a medical, fitness, or health-tracking product, and is not intended to diagnose, prevent, or treat any condition. Step and distance data shown in the App is provided for entertainment purposes alongside virtual route progress. Consult a qualified medical professional before beginning any walking program if you have health concerns.
11.3 Limitation of Liability
In no event shall Do Not Panic AS or its officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, punitive, or consequential damages whatsoever arising out of or related to your use of, or inability to use, the Service, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising from or relating to these Terms or the Service shall not exceed the amount paid by you to us in the 12 months preceding the event giving rise to liability or, if you have not made any payments, NOK 100.
12. Apple App Store: Required Provisions
This section applies to the App as obtained through the Apple App Store and is required by Apple Inc. (“Apple”) under its developer agreements. In the event of any inconsistency between this Section 12 and any other section of these Terms, this Section 12 controls.
- Acknowledgement. These Terms are between you and Do Not Panic AS only, and not with Apple. Apple is not responsible for the App or its content. To the extent these Terms provide for usage rules for the App that are less restrictive than, or in conflict with, the Apple Media Services Terms and Conditions, the more restrictive or conflicting Apple terms take precedence.
- Scope of License. The license granted to you in these Terms is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, in accordance with Apple’s usage rules.
- Maintenance and Support. Do Not Panic AS is solely responsible for any maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
- Warranty. Do Not Panic AS is solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of Do Not Panic AS.
- Product Claims. Do Not Panic AS, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession or use of the App, including (i) product liability claims, (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the App’s use of HealthKit.
- Intellectual Property Rights. In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Do Not Panic AS, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- Legal Compliance. You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer Address. For any questions, complaints, or claims with respect to the App, contact us at help@retrek.me. Do Not Panic AS is registered in Norway.
- Third-Party Beneficiary. You and Do Not Panic AS acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
13. Apple Media Services Terms
In addition to these Terms, your use of the App via the Apple App Store is governed by Apple’s Media Services Terms and Conditions, available at apple.com/legal/internet-services/itunes. Apple’s terms govern your relationship with Apple regarding the App Store, payments, and Apple’s platform; these Terms govern your relationship with Do Not Panic AS regarding the App itself.
14. Governing Law & Dispute Resolution
- These Terms are governed by the laws of the Kingdom of Norway.
- Any dispute arising under or related to these Terms shall be litigated exclusively in the district courts of Oslo, Kingdom of Norway, subject to the mandatory consumer protection laws of your country of residence within the EEA.
- Claims up to NOK 50,000 may be brought in small-claims court (Forliksrådet), with simplified procedures and fees.
